Child Safe Compliance (CSC) statements

A Child Safe Compliance (CSC) statement must be submitted to the Department of Human Services (DHS) by an organisation if they provide services or activities for children.

It confirms that your organisation:

• has child safe environment policies and procedures in place
• meets Working with Children Check (WWCC) requirements
• is taking steps to keep children safe.

Who must submit a CSC statement

It is a legal requirement to submit a CSC statement if your organisation provides services or activities for children in South Australia.

• Organisations are defined in Section 6 of the Child Safety (Prohibited Persons) Act 2016, and include:
  • state authorities
  • non-government organisations
  • sole traders
  • partnerships.
• Services and activities are defined in Section 7 of the Act. Examples are – but not limited to:
  • health services — including allied health practitioners
  • accommodation or residential services for children — including school camp providers
  • services provided by religious organisations
  • childcare or child-minding services
  • child protection services
  • coaching or tuition services for children
  • disability services for children
  • commercial services provided directly to children – for example, recreational or entertainment services
  • clubs and associations providing sporting, recreational, cultural or artistic activities for children
  • education services
  • justice and detention services for children
  • transport services for children.

When should an organisation submit a CSC statement

An organisation must submit a CSC statement:

• when it first starts providing services or activities for children, and
• each time its child safe policies or procedures are updated — child safe policies must be reviewed at least once every 5 years.

Requirements for your child safe policies and procedures

Your organisations child safe policies and procedures must meet South Australian legal requirements and follow the National Principles for Child Safe Organisations.

You do not need to upload your child safe policies or procedures when you submit your CSC statement.

The Department of Human Services (DHS) may request your child safe policies or procedures at any time, and you must provide them within 7 days.

Penalties

Your organisation may face a penalty of up to $10,000 if you do not submit a CSC statement.
